CGU / CGV — Conditions GĂ©nĂ©rales d'Utilisation et de Vente

1. Parties

Prestataire : UP-NETWORK SĂ rl, Boulevard de la Cluse 43, c/o Maceo Sahli, 1205 GenĂšve, Suisse (CHE-169.096.269), exploitant le service cdn.pizza.
Client : toute personne physique ou morale créant un compte sur cdn.pizza.

2. Description du service

cdn.pizza est un service de réseau de distribution de contenu (CDN) proposant :

  • HĂ©bergement et distribution de fichiers statiques
  • Gestion de zones DNS et certificats SSL automatiques
  • Protection WAF, rate limiting, Anti-DDoS
  • API REST, GraphQL, CLI et GitHub Action
  • Dashboard de gestion et analytics

3. AccĂšs et inscription

L'inscription est ouverte à toute personne majeure (18 ans ou plus) ou à toute entreprise légalement constituée. Le Client est responsable de la confidentialité de ses identifiants.

4. Tarification et facturation

4.1 Nodes Margherita (0 CHF/GB)

Le trafic acheminé via les nodes tarifés à 0 CHF/GB est gratuit et sans limite de volume. Aucun paiement n'est requis pour ces nodes.

4.2 Nodes Premium

100 GB de trafic premium est offert chaque mois calendaire. Au-delà, la facturation est déclenchée au tarif du node concerné (entre 0.02 et 0.05 CHF/GB selon le node). Les tarifs applicables sont affichés dans le dashboard.

4.3 Mode prépayé

Le service est exclusivement prépayé. Le Client crédite son compte via Payrexx avant consommation. Aucune ligne de crédit n'est accordée. Les crédits non utilisés n'expirent pas.

4.4 Non-remboursement

Les crédits rechargés sont non remboursables, sauf en cas d'erreur technique imputable à UP-NETWORK Sàrl dûment constatée.

⚠ Les factures sont Ă©mises par UP-NETWORK SĂ rl au nom de cdn.pizza. Les montants sont en CHF (francs suisses). La TVA suisse (8.1%) est applicable aux clients suisses.

5. Utilisation acceptable

Il est strictement interdit d'utiliser cdn.pizza pour :

  • Diffuser des contenus illĂ©gaux (pĂ©dopornographie, contenus haineux, etc.)
  • Lancer des attaques DDoS ou utiliser le rĂ©seau comme source d'attaques
  • Distribuer des malwares ou logiciels malveillants
  • Violer les droits de propriĂ©tĂ© intellectuelle de tiers
  • Contourner des restrictions gĂ©ographiques lĂ©gales
  • Spam ou hameçonnage (phishing)

Tout manquement entraßne la suspension immédiate du compte sans remboursement.

6. Niveau de service (SLA)

UP-NETWORK Sàrl s'engage à maintenir une disponibilité de 99.9% des nodes sur un mois glissant, hors :

  • Maintenances planifiĂ©es (annoncĂ©es 48h Ă  l'avance via dashboard)
  • ÉvĂ©nements de force majeure
  • Attaques volumĂ©triques dĂ©passant les capacitĂ©s de mitigation

En cas de non-respect du SLA, le Client peut demander un crédit de service équivalent au prorata du temps d'indisponibilité.

7. Suspension et résiliation

  • Par le Client : rĂ©siliation possible Ă  tout moment depuis le dashboard. Les crĂ©dits restants sont perdus.
  • Par UP-NETWORK SĂ rl : suspension immĂ©diate en cas d'abus, violation des prĂ©sentes CGU ou non-conformitĂ© lĂ©gale. RĂ©siliation avec 30 jours de prĂ©avis pour raisons commerciales.

8. Responsabilité

La responsabilitĂ© d'UP-NETWORK SĂ rl est limitĂ©e aux montants effectivement payĂ©s par le Client au cours des 3 derniers mois. UP-NETWORK SĂ rl ne saurait ĂȘtre tenu responsable des dommages indirects (perte de revenus, perte de donnĂ©es, atteinte Ă  la rĂ©putation).

Le Client est seul responsable des contenus diffusés via cdn.pizza.

9. Propriété intellectuelle

Le Client conserve tous droits sur les fichiers qu'il héberge. Il accorde à UP-NETWORK Sàrl une licence limitée, non exclusive, pour héberger et distribuer ces fichiers dans le cadre du service.

10. Modifications des CGU

UP-NETWORK Sàrl peut modifier les présentes conditions. Le Client en sera informé par e-mail au moins 30 jours avant l'entrée en vigueur. L'utilisation continue du service vaut acceptation.

11. Droit applicable et for

Les présentes CGU sont régies par le droit suisse. Tout litige sera soumis à la compétence exclusive des tribunaux du canton de GenÚve (Suisse). Application de la Convention de Vienne exclue.

Terms of Service

1. Parties

Provider: UP-NETWORK SĂ rl, Boulevard de la Cluse 43, c/o Maceo Sahli, 1205 Geneva, Switzerland (CHE-169.096.269), operating cdn.pizza.
Customer: any individual or legal entity creating an account on cdn.pizza.

2. Service description

cdn.pizza is a Content Delivery Network (CDN) service offering:

  • Static file hosting and global distribution
  • DNS zone management and automatic SSL certificates
  • WAF protection, rate limiting, Anti-DDoS
  • REST API, GraphQL, CLI and GitHub Action
  • Management dashboard and analytics

3. Access and registration

Registration is open to anyone aged 18 or over, or any legally incorporated company. The Customer is responsible for maintaining the confidentiality of their credentials.

4. Pricing and billing

4.1 Margherita nodes (0 CHF/GB)

Traffic routed through nodes priced at 0 CHF/GB is free with no volume limit. No payment is required for these nodes.

4.2 Premium nodes

100 GB of premium traffic is included each calendar month. Beyond that, billing applies at the rate of the relevant node (between 0.02 and 0.05 CHF/GB). Applicable rates are displayed in the dashboard.

4.3 Prepaid model

The service is exclusively prepaid. The Customer tops up their account via Payrexx before consumption. No credit line is granted. Unused credits do not expire.

4.4 No refunds

Topped-up credits are non-refundable, except in the case of a technical error attributable to UP-NETWORK SĂ rl and duly documented.

⚠ Invoices are issued by UP-NETWORK SĂ rl on behalf of cdn.pizza. Amounts are in CHF (Swiss francs). Swiss VAT (8.1%) applies to Swiss customers.

5. Acceptable use

It is strictly prohibited to use cdn.pizza to:

  • Distribute illegal content (child abuse material, hate speech, etc.)
  • Launch DDoS attacks or use the network as an attack source
  • Distribute malware or malicious software
  • Infringe third-party intellectual property rights
  • Circumvent legal geographical restrictions
  • Spam or phishing

Any breach results in immediate account suspension without refund.

6. Service Level Agreement (SLA)

UP-NETWORK SĂ rl commits to maintaining 99.9% node availability on a rolling monthly basis, excluding:

  • Scheduled maintenance (announced 48h in advance via dashboard)
  • Force majeure events
  • Volumetric attacks exceeding mitigation capacity

In case of SLA breach, the Customer may request a service credit proportional to the downtime period.

7. Suspension and termination

  • By the Customer: termination possible at any time from the dashboard. Remaining credits are forfeited.
  • By UP-NETWORK SĂ rl: immediate suspension for abuse, ToS breach or legal non-compliance. Termination with 30 days notice for commercial reasons.

8. Liability

UP-NETWORK SĂ rl's liability is limited to amounts actually paid by the Customer in the last 3 months. UP-NETWORK SĂ rl cannot be held liable for indirect damages (loss of revenue, data loss, reputational harm).

The Customer is solely responsible for content distributed through cdn.pizza.

9. Intellectual property

The Customer retains all rights to files they host. They grant UP-NETWORK SĂ rl a limited, non-exclusive licence to host and distribute these files as part of the service.

10. Changes to Terms

UP-NETWORK SĂ rl may amend these terms. The Customer will be notified by email at least 30 days before changes take effect. Continued use of the service constitutes acceptance.

11. Governing law and jurisdiction

These Terms are governed by Swiss law. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Canton of Geneva (Switzerland). The UN Convention on Contracts for the International Sale of Goods is excluded.

1. Vertragsparteien

Anbieter: UP-NETWORK SĂ rl, Boulevard de la Cluse 43, c/o Maceo Sahli, 1205 Genf, Schweiz (UID CHE-169.096.269), Betreiber von cdn.pizza.
Kunde: jede natĂŒrliche oder juristische Person, die ein Konto auf cdn.pizza erstellt.

2. Leistungsbeschreibung

cdn.pizza ist ein Content Delivery Network (CDN), das folgendes anbietet:

  • Hosting und globale Verteilung statischer Dateien
  • DNS-Zonenverwaltung und automatische SSL-Zertifikate
  • WAF-Schutz, Rate Limiting, Anti-DDoS
  • REST API, GraphQL, CLI und GitHub Action
  • Verwaltungs-Dashboard und Analytics

3. Zugang und Registrierung

Die Registrierung steht Personen ab 18 Jahren oder rechtlich gegrĂŒndeten Unternehmen offen. Der Kunde ist fĂŒr die Vertraulichkeit seiner Zugangsdaten verantwortlich.

4. Preise und Abrechnung

4.1 Margherita-Nodes (0 CHF/GB)

Über Nodes mit 0 CHF/GB abgewickelter Datenverkehr ist kostenlos und unbegrenzt. FĂŒr diese Nodes ist keine Zahlung erforderlich.

4.2 Premium-Nodes

Jeden Kalendermonat sind 100 GB Premium-Traffic inklusive. DarĂŒber hinaus wird zum Tarif des jeweiligen Nodes abgerechnet (zwischen 0.02 und 0.05 CHF/GB). Die geltenden Tarife werden im Dashboard angezeigt.

4.3 Vorauszahlungsmodell

Der Dienst ist ausschließlich als Vorauszahlung verfĂŒgbar. Der Kunde lĂ€dt sein Konto ĂŒber Payrexx vor dem Verbrauch auf. Es wird kein Kreditrahmen gewĂ€hrt. Nicht verbrauchte Guthaben verfallen nicht.

4.4 Keine RĂŒckerstattung

Aufgeladene Guthaben sind nicht erstattungsfĂ€hig, außer bei einem technischen Fehler seitens UP-NETWORK SĂ rl.

⚠ Rechnungen werden von UP-NETWORK SĂ rl im Namen von cdn.pizza ausgestellt. BetrĂ€ge in CHF. Schweizer MWST (8.1%) gilt fĂŒr Schweizer Kunden.

5. ZulÀssige Nutzung

Es ist strengstens verboten, cdn.pizza zu nutzen fĂŒr:

  • Verbreitung illegaler Inhalte (Kindesmissbrauch, Hassreden usw.)
  • DDoS-Angriffe oder Nutzung des Netzwerks als Angriffsquelle
  • Verbreitung von Malware oder schĂ€dlicher Software
  • Verletzung von Rechten Dritter am geistigen Eigentum
  • Umgehung gesetzlicher geografischer BeschrĂ€nkungen
  • Spam oder Phishing

Jeder Verstoß fĂŒhrt zur sofortigen Kontosperrung ohne RĂŒckerstattung.

6. Service Level Agreement (SLA)

UP-NETWORK SĂ rl verpflichtet sich zu einer Node-VerfĂŒgbarkeit von 99.9% auf monatlicher Basis, ausgenommen:

  • Geplante Wartungen (48h vorher im Dashboard angekĂŒndigt)
  • Ereignisse höherer Gewalt
  • Volumetrische Angriffe, die die MitigationskapazitĂ€t ĂŒberschreiten

7. Sperrung und KĂŒndigung

  • Durch den Kunden: KĂŒndigung jederzeit ĂŒber das Dashboard möglich. Verbleibendes Guthaben verfĂ€llt.
  • Durch UP-NETWORK SĂ rl: sofortige Sperrung bei Missbrauch oder AGB-Verstoß. KĂŒndigung mit 30 Tagen Frist aus geschĂ€ftlichen GrĂŒnden.

8. Haftung

Die Haftung von UP-NETWORK SĂ rl ist auf die in den letzten 3 Monaten tatsĂ€chlich gezahlten BetrĂ€ge begrenzt. UP-NETWORK SĂ rl haftet nicht fĂŒr mittelbare SchĂ€den.

9. Geistiges Eigentum

Der Kunde behÀlt alle Rechte an seinen gehosteten Dateien und erteilt UP-NETWORK Sàrl eine beschrÀnkte, nicht exklusive Lizenz zur Hosting und Verteilung im Rahmen des Dienstes.

10. Änderungen der AGB

UP-NETWORK Sàrl kann diese Bedingungen Àndern. Der Kunde wird per E-Mail mindestens 30 Tage vor Inkrafttreten informiert.

11. Anwendbares Recht und Gerichtsstand

Diese AGB unterliegen Schweizer Recht. Streitigkeiten unterliegen der ausschließlichen ZustĂ€ndigkeit der Gerichte des Kantons Genf (Schweiz). Das UN-Kaufrecht ist ausgeschlossen.
